Understanding your Colonia: a note from your president

 

Dear Fellow Homeowners in Conchas Chinas:

 

I want to bring to your attention some difficult decisions we’ll need to make in running our Homeowner’s Association if maintenance fees continue to stagnate and we remain unsuccessful in holding City authorities to our agreement with them to cooperate in collecting construction fees from developers. This latter problem has been with us from Day One and will not likely improve in the foreseeable future.

 

Construction Fees in 2008 are about 15% of what was collected in 2007. This despite a large number of construction projects initiated over the past 12-18 months in which the developers bypassed us. Prospects for 2009 assessments look equally dim. Maintenance fees during this period have remained fairly flat, with less than 40% participation among the total homeowners’ base.

 

Given this scenario, we simply cannot continue to maintain services as we have in over the past 2 years. Without higher fees participation among our neighbors, services will have to be reduced. The city will not maintain our streets, streetlights, common areas, clean up rainy season road debris, and regularly sweep our streets and clean the beach. Without our colonia maintenance, Conchas Chinas would slip into severe disrepair, and property values would plummet accordingly. It’s clearly in all our best interests that this not be allowed to happen.

 

We need your help. We encourage all who are now paying fees to sell your non-paying neighbors on the importance of a vital Homeowners’ Association. Our annual fees are extremely modest by any standard, and payback many times over. As it stands now for the coming year, we will be forced to cease all maintenance of streets and areas where fees participation is below 75%. Please help us get the word out that Association services will need to be cut from streets that are not contributing their fair share. It’s a shame that it’s come to this, but we need to be realistic and prudent in how we spend our limited resources. Hopefully all homeowners will choose to step forward and participate in the funding of the Association, and continue the high standards set by our predecessors in making Conchas Chinas a desirable place to invest and to live.

Condolences

 The Board would like to offer condolences to the family and friends of two of our past Presidents, Peter Gray and Tom LeBrun. They both contributed their time and talent for the good of all of us and they will be missed

 

What a Mess!!

CFE has hired an out-of town firm to replace some of the wiring in Conchas Chinas. They are proceeding one step at a time and the result is chaos on our streets.  The situation is dangerous to both people on foot and driving. We are trying to intervene, but do not have much hope that we will make a difference in how they are proceeding.  Until the situation gets resolved, please be vigilant.

 

Safety issues

 The slow economy world wide seems to have sparked problems in Vallarta,too. There have been reports of robbery break-ins in houses and condos. On the beach side there have been some reports of unprovoked assaults. So it is time to heed all the normal deterrents...like keep your doors locked and lights on at night. Notify your staffs of problems. Don't put yourself in compromising situations.

Adopt a Fountain in action

 

The program started last year to care for and nurture your neighborhood fountains is alive and well!

 

The fountain at Rinconada Madre Perla sits between the condominiums Costa de Oro , Los Caracoles, and Punta Esmeralda.  This has been a pesky problem fountain due to the fact that it leaks and there is a faulty pump.  The CCHA has tried three times to repair it and it continues to be a problem.

 

The current president of Costa de Oro, Jim Brophy and his cohorts, Greg LeBaron and Colin Jenkinson have been hard at work dismantling the fountain and are going to fix it once and for all. 

We thank them for their expertise, energy and tireless efforts to improve the neighborhood! 

 

Kudos also to World International Vacation Club and Villa Las Brisas for maintaining their fountains.

Understanding your Colonia

 

About 60 members attended the General Assembly meeting on Feb. 29, 2008, at Club Alejandra.  Copies of the President’s Address, 2007 Financial Report, and 2007 Maintanence Director’s Report are now on our website. Minutes of the meeting must be translated in both English and Spanish and then certified by a notary. Once this process is complete, you will also be able to find them on the web.

 

City News

 

Efforts have been underway for some time to facilitate a drive-thru inspection with Arq. Banos and the City Inspector who is in charge of inspections for the South of Vallarta. There are currently 5 projects within the Colonia that appear to the Association to be operating without viable City or Colonia permits. Our efforts have paid off! On March 24 & 25, Arq. Banos was accompanied by first 3 and then 5 of the 19 City inspectors. All 5 sites were cited for a variety of violations, some were fined, while others were given a specific time period in which to comply or have stop work orders enforced.  Your association will continue to stay on top of these issues to be sure that the contingencies are met within the times specified or that the work is shut down.

 

Work continues with the City for the addition of a left turn lane and beautification of the North Entrance. Currently, the project is being sent to the Federal Gov’t as the turn lane will require repositioning of the highway. As the local government has approved the project, this does not require approval of the Federal Government, but there is a notification process that is required.

·        The following Condo Associations have taken advantage of the CCHA Condo Discount program and saved their owners 15% on their 2008 dues.

·        Prior to the General Meeting at Club Alejandro, a new street sign was placed at the entrance of Calle Sagitario, after last year’s sign was vandalized and had to be removed.

·        Thanks to Peter Olsen, Calle Sagitario (Calle Easy) has received new signage and additional lighting.  In an effort to reduce traffic on this dead end street, signage now clearly shows which properties are accessed by the road. Lighting, directed toward the pump station, was installed to reduce the nighttime partying there.  Thanks Peter, for your continued efforts to improve the Colonia.

·        Thanks also go to Gerald Rapp for his repairs to Calle Leo and Calle Santa Barbara!

·        Continued efforts by the Board to work with the City on defining the boundaries of Conchas Chinas may finally be coming to fruition. It appears that the City will decide on Calle Leo as the north boundary for Lower Conchas Chinas. Confusion on this boundary has persisted since the City changed our Convenio to facilitate installing sewer lines along Calle Santa Barbara.  Once finalized by the City, properties along the south side of Calle Leo will be in Colonia Conchas Chinas and properties along the north side of Calle Leo will be in Colonia Amapas.

 

 What´s ahead

 

ZONING PLAN: Your board has contracted Arq. Alfonso Banos and his staff to study and devise a zoning plan for Conchas Chinas based on current and desired land usage. Once this “desarollo plano parcial” is presented and approved by the board, it will be presented to the general assembly, 30 days will be given for public review and study, and a vote will be taken by the membership. Once passed, the plan becomes a binding land use document for assessing future development requests in the Colonia. Stay tuned for future notices about this very important project.

 

STEP REPAIR:  The beach steps leading the beach by Club Alejandro are in need of repair.  Your Board has worked with the City to replace the iron railings (with a PVC/concrete system which will withstand the constant sun and salt) and to repair the damaged steps.

           

Help Wanted!

As always, your Association is in need of concerned citizens!  Currently there are several fountains in the Colonia who need devoted “parents” to oversee their restoration and beautification.  Additionally, if you have a pet project you would like to work on, we welcome your inquiry.  The Board is always looking for ways to improve the Colonia and for people who would like to assist in that endeavor.

 

We Got Mail!

 

“…………..I am wondering, however, why no money seems to be spent on neighborhood clean-up in Upper Conchas Chinas.  For example there has been a dead Christmas tree and a paint bucket prominently displayed in the green belt for months.  Is any of our $300 to be spent on cleaning common areas?  I await your answer prior to any dues payments. Thanks, Neil S.”

The majority of dues collected in the Colonia is spent on clean-up: beach, road ways, land and rock slides caused by the rain etc. The Colonia has 3 employees who handle this work. There is a recommended work schedule by area; however this is flexible to accommodate unusual demand ie extra beach clean-up days over Easter etc. After receiving Neil’s letter, the Board revisited the employee policies and have made some changes:

 

·        The employees are instructed to clean up the sidewalks, roads, beaches and garden areas at the North and South entrances, but no debris from private property, i.e. areas beyond the sidewalks. The board has clarified with the employees that the green space going up Calle Madre Perla is common space not private and needs to be added to their work schedule.

·        One worker has been given supervisory duties and is turning in a weekly log detailing what areas were worked on each day. As in the past, street cleaning priority is given to the streets where the majority of residents are current on their dues payments.

·        Workers will be required to wear new BRIGHTLY colored work shirts provided by the Colonia. This should help make it easier for homeowners to see when clean-up is being completed in their area.

 

The Board hopes these changes will result in continued improvements within the Colonia. Thanks Neil for bringing your concerns to light, and for paying your dues!

Maintenance Director’s Report 2008

I wish to extend our appreciation to the property owners of Condominio Club Alejandro for once again allowing the CCHA to hold their AGM under their lovely palapa. You may be happy to learn that Conchas Chinas is recognized as the premier colonia in Puerto Vallarta, which has 180 such colonias. Your CCHA Voluntary board Members and Committees intend to maintain this enviable distinction with the assistance of our property owners, and some new volunteers to lend a helping hand. A big thanks to our hard working "Membership Vocals", Lynda Petty & Susan Kasperson, who are responsible for the informative "Newsletters" e-mailed throughout the year, highlighting important events and issues.

 

Our goal is to maintain and improve conditions within upper and lower Conchas Chinas to protect our property values by making Conchas Chinas a desirable place to live. Most of you are aware that the City provides only Police/Fire protection & Garbage Collection.

As Your Director of Maintenance, I would like to enumerate a partial list of tasks performed in my areas of responsibility, with limited funds and staff:

 

A.   Meet with City officials to seek support for CCHA projects, which improve infrastructure and safety concerns.

B.   Constantly monitor and report utility failures to the proper authorities, and insure that repairs are made in a timely fashion and with proper restoration to the repair sites, which we pay to maintain.

C. Review and approve New construction and remodel projects to insure compliance to code, and the rights of the neighbors, by enforcing the work days and hours of work.

D. Maintain & Repair all Cobblestone Roads & Sidewalks to provide safe passage.

E.   Maintain & Repair all Street Lights and Poles, including underground wiring system.

F.   Maintain & Repair all Common area Planters & Gardens, including providing a source of water to maintain plants

G. Removal & disposal of all Common area Trash & Debris.

H. Maintain & Sweep all Common Areas, with a defined zoned work schedule recently in effect.

 I.   Maintain & Clean the Conchas Chinas beach for the benefit of residents and tourists.

 J. Provide Trash Receptacles strategically throughout the Colonia and Beach.

 K. Maintain Tool & Garden Storage Bodega at the South entrance, and replace tools as needed.

 L. Maintain a full time work crew of (3) men, Jacinto, Nicolas, and Vidal.

 M.     Retain the services of Sam Martinez as Admin. Assistant & Expeditor, and his able assistance is vital.

 N. Retain a Consulting Architect, Arq. Alfonso Banos, to review construction plans and offer input.

 O.     Make regular tour inspections of our colonia looking for Sanitation & Safety concerns.

 P. Publish & Distribute Public Service notices, which may be found at: www.conchaschinas.net.

 Q. Insure that non-permitted, illegal signs placed in common areas, are removed.

 R.  Place signs where necessary to improve safety conditions at our entrances & exits.

 S.  Assist property owners with reporting Loud Noise & Music in violation of the city curfew of 12 pm.

 T. Report major Rock & Soil Slides within Common areas to Obras Publicas, and seek the removal.

 U. Monitor and report Rock & Soils Slides which impede traffic, and seek the voluntary cooperation of the responsible property owner to remove all such debris at their expense.

 V. Obtain cooperation from all Owners/contractors in promptly removing all personal Construction Materials & Debris allowed to fall onto Common Roads & Sidewalks, and thereby creating traffic hazards.

 W.  Monitor & Report tour buses and trucks parking at our entrance aprons and creating unsafe conditions for entry & exit of residents and guests.

 

I believe we have accomplished many worthwhile projects since our last General Assembly on 23 Feb 2007, and here are some of the highlights:

 

1)  Road Repairs made in lower & upper Conchas Chinas:[photo board]

a.   Major road repairs were done in March 2007 on Capricornio/Calle Leo in front of Casa Celeste. The cost of $93,128 pesos were shared as per agreement, 50% CCHA and 50% Peter Olsen [see photos]

b.   I authorized much needed emergency road repairs in many high traffic areas. A three man crew performed the repairs from August 6-11th 2007, and the cost for labor was $13,000 pesos plus materials.

c.   I authorized more necessary road repairs in lower & upper Conchas Chinas, which were completed on 12/15/2007, and the costs for labor were $12,500 pesos plus materials.

d.   In addition, our (3) man crew did some minor emergency repairs throughout the colonia.

 

2)  Street Lighting & Pole Maintenance, Including Underground Wiring System:

a.   We continue our best efforts to respond to e-mails and phone reports indicating street light failures, along with periodic night tours by Sam Martinez who marks a road map with the location of each non-functioning light. The repair work is done by an engineer from the Electricial Commission, Esteban Villegas Escobedo.

I am sure you all understand that we are not able to make repairs to a single street light, and must wait to accumulate a few out-of-service lights to make it practical for the crew and equipment to make the repairs. Repairs were made throughout the past year in lower & upper Conchas Chinas.

b.  In May 2007 we replaced the badly leaning street light pole on Madre Perlas across from Do Re Mi, along with (5) non-working streetlights.

c.   In August 2007 we repaired a string of lights from below Ocho Cascades all the way up Madre Perlas & Las Ostras. We also repaired (4) non-working lights on Sagitario. Total cost paid was $5,700 pesos.

d.   We repaired (2) lights on Santa Barbara in Jan 2008, reported by Jerry Rapp.

e.   The aging underground wiring system continues to decay at an alarming rate, but at this point we are not in a position to consider such an expensive project until we have a new source of large revenues/ and/ or City participation. The CCHA pays all expenses in maintaining the lighting system, and the city provides only the electric power to operate the lights.

 

3)  Seapal Repairs to Water & Sewer Lines [photo board]:

a.   The photo boards show just a few examples of the many repair sites which are too numerous to list for this narrative, but be assured the incidents of ruptured lines is on the increase.

b .  Finally in March of 2007, Seapal located a lost water line needed to bring water to the condo on the south side of Madre Perlas just below La Punta. Seapal dug a trench across the road in Nov 2006 and never repaired the damaged cobblestone surface since they were unable to locate the lost water line, despite many complaints from your CCHA demanding that they restore the cobblestone surface.

c.   In May 2007 your CCHA President send a letter to the General Director of Seapal Vallarta expressing concern for Seapal's capacity to provide new service to upcoming projects in Conchas Chinas.In reply to our concerns Seapal states: "From now on, every time there is a possible project in Conchas Chinas, Seapal will inform you about the capacity of the water services in the area and if it is necessary, we will verify and make sure that the needed infrastructure is available, so we can cover the service of the developer, without affecting the colonia."

d.    Our North down exit ramp has had numerous line ruptures starting in May 2007, when a large crew of (8) men removed large sections of the traction grid/cobblestone down ramp near the highway, in their quest of locate an elusive water line break [graphic photos on board]. We warned all residents to use the South Entrance and Exit until further Notice.

 In late Dec 2007 we had a major water line rupture at the top of the North down ramp, which required a total water pressure shut down for more than two hours while emergency repairs were made in the evening hours on Friday, 28 Dec. 2007.  The down ramp was again closed to traffic and a notice was sent to use the South entrance & exit during this period. The down ramp was reopened to traffic over the week-end, but Seapal did not properly restore the concrete traction grids.

Another major water line rupture on our North down exit ramp occurred on Jan 13, 2008, in almost the exact same spot as was repaired by Seapal back on 5-29-07. The  Seapal crew responded to Sam's emergency call and shut down the water pressure which was flooding the federal highway due to the tremendous pressure from the Seapal line rupture.[photos]. The Seapal attempt to repair our concrete ramp resulted in the worse repairs ever done by Seapal. This was the final straw, and the CCHA delivered a letter of protest to the Director General of Seapal Vallarta signed by our President, Tari Bowman, describing the frequency of recent major pipe breaks on the north exit ramp, and described the poor quality work done by Seapal, and the need for the Director to look into the matter and take appropriate action to restore our north exit ramp to the condition prior to Seapals numerous removal of large sections of our concrete reinforced ramp. We are awaiting a response to our request.

 

4)  Expanded Work Force [photo & document board]

We now have a (3) man work force, Jacinto, Nicolas, and Vidal. Vidal was hired in early August 2007. We are fortunate that Jacinto has a pick-up, which allows our workers to be moved to their designated work site to meet their daily work schedule. In early August 2007, Thom Rogers developed a printed work schedule after meeting with our (3) workers, and you can see the posted weekly schedule now in effect, with a color coded schedule by zone. [see the posted 7 August 07  document from Thom Rogers, as well as the color coded map daily work schedule].  I am sure you have all noticed the dramatic improvements with better coverage & work production throughout our colonia.  A  big thanks to Thom Rogers for his efforts in our behalf.

 

5)  Restoration of Badly Rusted Iron Railing on Beach Stairway at Club Alejandro: [photo board]

This project was done in early June 2007 with high quality, weather resident materials. Materials = $1,300 and labor =$4,800, for a total of $6,100 pesos.

 

6)  Seapal Water Meter on our North Exit Ramp to Service our North Entrance Gardens:[photo board]

In early August 2007 Thom Rogers received approval from Seapal to install a new water meter, which required that the CCHA sign a contract in the amount of $1,674, plus an installation fee of $4,763.Before the installation of the meter, we constructed a small 80x80cm wall for Seapal to attach their meter, as well as a locked concrete compartment to store the hose to be used to water the plants & gardens.

 

7)  Restoration of Madre Perla Concrete & Brick Arch at South Entrance: [photo board]

Our South entrance white arch was transformed to its former beauty, including the light post bases, and white curbing around the island. Two workers totally cleaned and scraped, pressured washed all surfaces in preparation for painting, and the work was completed on 24 Dec.2007.

 

8)  At Long Last, Parks & Gardens Started Tree Trimming Maintenance at our South Entrance: [photos]

Thom Rogers’ efforts were rewarded and Thom monitored the trimming process. Thanks Thom.

 

9) To Report Loud Rowdy Behavior or Excessively Loud Music/Noise After Midnight: call Seguridad Publicas @ 290-0512 or Central Emergency Line #066[new]

 

10) CFE  ACTIVITIES  IN CONCHAS CHINAS: [photo board]

a.   On April 9, 2007 CFE cut many tree limbs near the Bombero station at our South entrance, to free up power lines. The power went out numerous times with a loud "Big Bang" sound heard everywhere.

b.   It was reported in late April 2007, that there was a broken CFE cover on Calle Sagitario exposing travelers to a hazard, just south of the Applegate construction. We were successful in getting the cooperation of CFE to replace the broken CFE cover, which was leaning against the wall [photo]

c.   On May 3, 2007 there were numerous power outages on Paseo de los Delfines, with some huge power spikes which caused big Internet connection problems in the neighbor -hood. CFE set up some temporary equipment indicating DANGER 100,000 volts, sitting on the sidewalk just below Castillo. I sent out an e-mail to immediate neighbors, advising them to avoid walking in this area with children or animals until the provisional power supply is removed. Finally, on Monday 14, 2007, CFE located and repaired the damaged underground cable which had been causing periodic power problems for two weeks.[photo board]

 

11) Erroneous report in mid April 2007 that a dangerous Landside in Amapas was reported to have happened in Conchas Chinas: Your CCHA board notified the newspaper editor requesting that the paper print a retraction and correct the record.

 

12) The CCHA Board officially challenged the illegal construction of a barrier fence by the developers at the base of Miramar, which effectively blocks access to the cul-de-sac turn around on Rinconada Conchas Chinas.

 

13) Construction Site Land Slides & Construction Debris on Public Roads:[ photo boards]

a.   "Grand Vista", the project by Mr. Busby ,lot 23-sect 9, on Paseo de los Corales, was guilty of gross negligence, and extreme inconsideration for his neighbors by depositing large amounts of construction materials and hardened cement on our public roads. Many warnings were issued to obtain compliance.

b.   We have generally been successful in getting immediate action by the responsible parties to remove their land slide material and / or construction slide materials which have fallen onto our public roads.

c.  Please identify & report all instances where concrete trucks moving up to construction sites, are dumping partial loads of wet concrete onto our roads, creating damage and potential hazard to vehicles following.

 

    OUR WISH LIST OF NECESSARY PROJECTS WHEN FUNDING IS AVAILIBLE

1.      North Entrance Highway entry with attractive stone retaining walls/planter and Conchas Chinas signage, together with dedicated left turn lane with speed reducers. This solution will remove the dreaded hazard of busses parking on our aprons and creating entrance and exit hazards. [We hope to report the current status of this worthwhile project]

2.      Consider viable options to replace our aging underground wiring system for all streetlights, by rewiring the power grid. This will be a hugely expensive project.

3.      Update gardens at North & South entrances, overlook, corner of Madre Perlas and Delfines, and provide for their proper upkeep.

4.      Evaluate roads in upper & lower Conchas Chinas where traction is a problem, particularly during the rainy season, and select sections of roads which need the installation of concrete ribbed traction grids which have proved so effective in improving traction on our north entrance ramp since their installation.

5.      Propose "Adopt-A- Fountain" for those fountains not presently being maintained. Based upon Susan Kasperson's April 2007 site evaluation, it appears that 4 out of the 7 fountains are actually looking very good. [photo board] The "Adopt a Fountain Program" would seem to be a much better option than having the new city administration cover the cost of removing some of our fountains and paving over the vacated area [donating the unwanted fountains to the City]

Cyclones & Storms Prediction: May 2007

Gilberto Hugo Garcia Moran,Municipal Protection, announced that the official season of cyclones and tropical storms starts May 15th.

 

Announced were the prediction of:

Seven (7)  Tropical storms

Six (6)      Category 1 or 2 Hurricanes

Two (2)     Category 3,4 or 5 Hurricanes

 

Names of the storms will be: Alvin, Barbara, Cosme, Dalila, Erick, Flossie, Gil

                                                Henriette, Ivo, Juliette, Kiko, Lorena, Manuel, Narda, Octave, Priscila,

                                                Raymond, Sonia, Tico and Velma 

 

Advice from Ecological Group: May 2007

Government and civic groups mentioned in a recent Tribuna article have called for the residents of Col. Las Amapas and Conchas Chinas to request their professional expertise in preventing potential damage which may result from the coming rains of summer:

Consejo Directivo del Colegio de Ingeniería Civil de Jalisco (CICEJ), Armando Mora

We have previously advised that Obras Públicas and Planeación Urbano from the Municipio of Puerto Vallarta have also offered their expertise.

For several years, we have provided a Denuncia Popular which is directed to the Department of Ecología Municipal. This form FOLLOWS.

While we do not personally believe that these departments and civic groups will necessarily correct the ecological damage that has already been done in the Col. Amapas and Conchas Chinas areas, we would consider it important to document your concerns for potential property damage with the rainy season which shall begin within the coming weeks. (CITY REGULATION FOR THE PROTECTION OF THE ENVIRONMENT

CHAPTER TWO

COMPLAINTS AND COMMUNITY PARTICIPATION)

 

Art. 15.- La denuncia popular es el instrumento jurídico por medio del cual toda persona física o jurídica, pública o privada, puede hacer saber a la autoridad competente del município acerca de todo fuente de contaminación o impacto ambiental, de los daños causados a los recursos naturales, así como del responsabilidad de los mismos; todo ello con el fin de que la autoridad facultada atienda y solucione la queja presentada.

 

(Article 15.- An Ecological Complaint is a legal procedure whereby any individual or legal entity, both public and private, can advise the corresponding city authority of any source of contamination or environmental impact; damages caused to the environment as well as those who may be responsible for those damages, so that the authority which has jurisdiction over the complaint can respond to and resolve the nature of the complaint.)

 

Art. 17.- Corresponde tanto a las autoridades como al sector social, privado y a los ciudadanos en general, la protección de los ecosistemas, así como la prevención y correción de los impactos que en ellos se puedan presentar, con el fin de preservar y mejorar las condiciones del ambiente.  Por lo tanto, la autoridad solicitará de la ciudadanía y los demás sectores que documenten sus denuncias y, en los casos en que sea posible, las presenten por escrito o; llenen los formatos preestablecidos, siendo obligación de la autoridad mantener el carácter confidencial de la identidad del denunciante.

 

(Article 17.- It is the responsibility of the authorities as well as the public and private sector and the community in general the protection of the ecosystems, the prevention and correction of the environmental impacts which may occur, so as to preserve and improve the environmental conditions.  As such, the authorities shall request the community, and any sector thereof, to document their complaints and, where possible, that they be presented in writing, or present the form provided by the authorities, it being the obligation of the authorities to maintain the identity of the person making the complaint in confidence.)

                        

 

 

Landslide in Amapas   April 2007

Last week a landslide in Amapas was erroneously reported to have happened in Conchas Chinas.  The foundation of a building was undermined by the lower abutting construction of Villas de la Colina II, causing it to slide and break apart.  Fortunately, there were no fatalities.


The Board of the Conchas Chinas Homeowners Association (CCHA) has been bombarded with questions from other homeowners about this, along with renewed complaints of overbuilding in Conchas Chinas. The CCHA would like to emphatically express to its homeowners and to the public that that the landslide did not occur in Conchas Chinas.

 

The new city administration has taken the proactive step of asking the Governor of Jalisco to investigate all permits issued in December of 2006. So far, according to the Municipal website, some 70 projects have been identified. While the Conchas Chinas Homeowners Association can't do anything about permits issued in other colonias, they can and are working with the city to stop projects that were permitted without the approval of the CCHA board.

 

Many Conchas Chinas homeowners and some real estate firms don't understand the CCHA involvement in the construction approval process.  CCHA has a contract (Convenio) with the City which gives CCHA the responsibility of and the authority to review all proposed construction plans to insure the plans comply with city and state regulated density, height, easements and off street parking.  These determinations are made by a certified architect who advises the board. A plan review fee is charged by CCHA.  Upon paying these fees and receiving the approval of CCHA, the plans can then be submitted to Planeacion for city permits. This
